Business Terms and Conditions

TJ Miller LTD

 

SERVICES:

TJ Miller Ltd on receiving an instruction will arrange for photographs, floor plans and marketing details to be put together. These will be made available to interested parties and may be distributed within the following:

  1. Internal lettings lists
  2. Window displays
  3. Website – www.Tjmiller.co.uk
  4. Property portals
  5. Relocation Agencies
  6. Leaflets, Newspaper & Magazine Adverts

Introduction of Tenant(s) on a Let only service

TJ Miller will take all the essential steps to achieve a successful business deal and will:

  1. Circulate and advertise the property details to prospective tenants to generate interest n the Property once TJ Miller receives instructions from the Landlord. Once a suitable applicant is found, a viewing will be arranged of the property and the Agent will (after having obtained sufficient references and credit checks, the costs of which will be borne by the applicant(s)) negotiate the terms and conditions of the proposed tenancy agreement which will be drafted by the Landlord.
  2. Negotiate the terms of the tenancy agreement between the Landlord and the Tenant(s).
  3. Acquire full credit checks, personal references which are confirmed by an independent credit referencing agency or obtain personal references and a letter of guarantee if a credit search is not suitable. (We cannot accept responsibility for the accuracy of the information given to us by the tenant(s) or the checks from such companies.)
  4. Arrange for an inventory clerk to prepare a full inventory at the start of every tenancy, who will make a separate charge for this. Unless otherwise instructed by the landlord.
  5. Collect the tenancy deposit and the landlord will prepare the tenancy agreement (including the inventory if applicable). The agent will obtain the tenant(s) signatures to tenancy agreement, unless otherwise instructed.
  6. Not arrange for the connection or disconnection of the utility services and furthermore the agent will not be held responsible for the forwarding of meter readings taken by the landlord or tenant(s) to the relevant utility companies.

 

Management Service

 

In addition to the letting service TJ MILLER will:

 

  • Arrange for the collection of due rents in relation with the tenancy agreement. However, the agent cannot be held responsible or liable if the tenant(s) fail or delay any rental payments.

 

  • At the instructions of the Landlord, will begin possession proceedings of the property via a solicitor, appointed by the agent, unless otherwise instructed. Should this be required then both the landlord and the agent shall liaise with the solicitor, whose fees shall be the responsibility of the landlord.

 

  • Make every effort to notify the relevant utility companies and the local authority to transfer the utility services and council tax onto the name of the tenant at the start of every tenancy. TJ MILLER will not accept any responsibility for the failure of the tenants to pay bills or any delays on the part of the utility companies during the tenancy term.

 

  • Generally, manage the Property on a daily basis. In the event of minor repairs, estimates will be obtained and forwarded to you for your approval along with emergency works, redecoration, renewals, or repairs. In the case of an emergency. Where TJ MILLER are unable to reach you we will use our discretion to authorize any works. Such decisions are to be accepted by and are binding on you.

 

  • Arrange and supervise any cleaning, repairs or replacements that are required or deemed necessary by TJ MILLER will be payable by the Landlord.

 

  • Carry out yearly maintenance including safety certificates where applicable.

 

  • Notify you of any structural or serious defects in the property or contents which come to our notice or notified by the tenant(s) we shall inform you and wait your instructions.

 

  1. Arrange at the commencement and at the expiration of the tenancy agreement of the occupancy the property inspection of the Landlords inventory. Also, the agent shall seek to negotiate and agree the appropriate deductions from the tenant(s) deposit if necessary, with consent of both the landlord and tenant. Furthermore, the Landlord indemnifies the agent against all claim(s) arising from any works, repairs or maintenance required or carried out at the premises. The landlord authorizes the agent to carry out any electrical, gas, remedial or servicing work that may be required to the property during the tenancy. In the event of an emergency repair, the landlord authorizes an amount of £250 to be used to the cover the costs of the works. Every attempt will be made to contact the landlord in order to allow the landlord to appoint their own contractor, before an approved contractor being appointed by the agent. It is the landlord’s responsibility to ensure that all service charges and ground rents are paid on time. Any delays in doing so could be subject to payment charges, interest and additional legal costs charged by the management company. TJ MILLER will not accept any responsibility for any costs as a result of the Landlord delaying or nonpayment of the above charges.

The management agreement can be terminated after the minimum period of three months by either the landlord or the agent giving a minimum of one months’ notice to the other. On the termination of the management agreement, we will revert to the lettings only service, unless otherwise instructed by the landlord.

 

Short Term Tenancies

 

For TJ MILLER to introduce a tenant(s) for a short-term tenancy the landlord agrees to pay a fee of 20% plus VAT of the total rental amount for the tenancy term. No references or inventory will be obtained unless requested by the landlord before the tenancy commencement. For short term tenancies TJ MILLER will provide in place of an inventory a check-in, for references the agent will provide credit card details and a letter of guarantee from the tenant(s) as a deposit. The landlord is responsible for acquiring all permissions that may be required under the head lease or by the managing agents or any other relevant bodies for short term tenancies.

 

Agreement Termination

 

  • This agreement shall be terminated forthwith on notice in writing addressed to the landlord and sent by recorded delivery if the agent wished as a result of any breach of the agreement caused by the landlord’s act, default or omission in relation to any of the landlords obligations described in this agreement.

 

  • The landlord may give 14 days’ notice by way of recorded delivery of his intention to terminate this agreement with no charges or fees payable by the landlord – NO LET NO FEES. For the avoidance of doubt the landlord is not obliged to accept any tenant put forward by the Agent.

    Letting Fee Agreement

    ¨  Letting Introduction Services:

    The Landlord instructs the Agent to conduct a Letting Introduction Service as stipulated in Section found. Of these Terms of Business and further agrees to the following Letting Introduction Terms.

    FEE:

    8.5% of the gross rental due for the entire agreed term of the tenancy inclusive of VAT, subject to a minimum fee of £800.00 inclusive of VAT.

    Please note that the Abortive Tenancy clause is chargeable as per Section.

    The fees are payable in advance and at the commencement of the Tenancy and will be deducted from monies received by the Agent on the Landlord’s behalf. Any subsequent extension, renewal or continuation of the Tenancy will be subject to the same fee and is payable thereof at the same rate and in the same manner.

    RENEWALS:

    Where, with the consent of the landlord, the tenancy is renewed or extended to the same tenant (or any person associated with the tenant) originally introduced by the Agent, a renewal fee equivalent to 8.5% of the gross rental for the agreed term of the tenancy inclusive of VAT, subject to minimum of £800.00 inclusive of VAT, shall be payable on the renewal date. The Agent shall prepare the tenancy agreement, if required, for the new or extended tenancy and the terms of this agreement shall continue until the tenant leaves, or this agreement is terminated.

     

     

     

     

     

     

     

     


    ¨  Standard Management Services:

    The Landlord instructs the Agent to conduct a Letting Introduction Service as stipulated in these Terms of Business and further agrees to the following Management Terms.

    MANAGEMENT FEE:

    Management charge is a monthly fee of 10 % (Provided no guaranteed rent been offered) for the entire agreed term of the Tenancy agreement and any further re-newels or extensions thereafter.

    PAYABLE:

    The initial set up fees are payable in advance and/or at the commencement of the Tenancy.  Fees will be deducted from the first payment of rent. Management fee is payable from the first month and is to be paid monthly which will be deducted from the rental monies received.

    RENEWED TENANCY AGREEMENT:

    Any further renewal or extension of tenancy a charge of £250.00 is payable to cover the cost of preparing new documentation, arranging, and supervising the signing and execution of the new agreement.
